No lawyers, I just need someone that can find me California Labor Code laws and OSHA regulations.
To be a little more specific, here's how the work day goes, just to give you an idea of what I'm looking for:
7am-9am - work
9am-9:30am - 30 minute break
9:30a-2:30p - work
2:30-2:40 - 10 minute break
Now, from here, I'll either be told to work for 10 minutes and go on my last ten minute break (right before I get off the clock) or they'll have me take my second 10 minute break immediately after taking my first ten minute break. I don't think that's right, and I also believe that the lunch break is supposed to come in the middle of your shift, with the ten minute breaks on either side.
Also, I believe OSHA has interpreted part of it's sanitation regulations to address the need for bathroom breaks - my employer tends to only allow bathroom breaks while we're on our breaks and lunch break while OSHA mandates accessible bathroom facilities for employees to use at any time.
In addition, our employer has a policy of "No breaks of any kind between 11am-1:30pm" and I believe that comes in violation of California Labor Code.
Finally, California Labor code 226.7 requires employers to pay employees an extra hour for the workday if the employee missed any of their break periods due to management not giving the break. Guess what? My employer hasn't paid ANYONE their dues in this matter. No help needed there, as I know what to do about that.
My problem is my internet is ungodly spotty right now, and even as I type this the net is going up and down.
Can anyone help me or perhaps give me a relevant phone number in California (Redlands, if possible) so that I may address this?
